Terms of Service

Welcome to Qwiko. By downloading, accessing, or using the Qwiko mobile application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the App.

Qwiko is a technology platform that connects passengers with independent auto rickshaw drivers. Qwiko does not provide transportation services and does not own or operate vehicles. All rides are provided by third-party drivers, and fare-related discussions or settlements (if any) happen directly between passengers and drivers.

To use Qwiko, you must:

• Be at least 18 years old
• Provide accurate and complete information during registration
• Comply with all applicable local laws and regulations

Qwiko reserves the right to suspend or terminate accounts that violate these requirements.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account

Qwiko is not responsible for any loss caused by unauthorized access resulting from your failure to secure your account.

Passengers may use the App to:

• Request rides from nearby available drivers
• Track rides and view trip history

Code of Conduct

Passengers agree to:

• Treat drivers respectfully
• Provide accurate pickup and destination details
• Avoid misuse, spam bookings, or intentional false requests

Repeated cancellations, misuse, or abusive behavior may result in account suspension or termination.

Drivers using Qwiko:

• Are independent contractors and not employees, agents, or partners of Qwiko
• Must provide valid vehicle documents, licenses, and required permits
• Are solely responsible for compliance with all transport, tax, and safety laws

Qwiko reserves the right to approve, reject, suspend, or deactivate driver accounts at its discretion.

Qwiko does not currently process payments within the App.

• Qwiko does not collect fares, commissions, or service charges
• Qwiko is not responsible for any fare disputes, cash handling, or payment-related disagreements between passengers and drivers

Any future introduction of paid features or monetization will be clearly communicated in advance.

Qwiko may provide safety-related features such as emergency contact settings; however:

• Qwiko does not guarantee the safety, behavior, or conduct of users
• Users are responsible for exercising personal judgment during rides

In case of emergencies, users should immediately contact local authorities.

Users must not:

• Use the App for unlawful purposes
• Provide false, misleading, or fraudulent information
• Harass, threaten, or abuse other users
• Attempt to hack, reverse-engineer, manipulate, or disrupt the App or its services

Violations may result in immediate and permanent account termination.

To the maximum extent permitted by law:

• Qwiko is not liable for injuries, damages, losses, delays, cancellations, or disputes arising from rides
• Qwiko is not responsible for driver conduct, vehicle condition, or service quality

Use of the App is entirely at your own risk.

Qwiko does not guarantee:

• Driver availability at all times
• Successful ride matching
• Uninterrupted or error-free operation of the App

The service may be suspended or modified for maintenance, updates, or technical reasons.

Qwiko may suspend or terminate your access:

• Without prior notice
• For violation of these Terms
• For legal, security, or operational reasons

Qwiko may update these Terms from time to time. Updated Terms will be posted within the App. Continued use after updates constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of India, with jurisdiction in the state of Kerala.
